CPSIA 2008 Compliance Statement

Dear Valued Customers,

The Consumer Product Safety Improvement Act (CPSIA) became law in August 2008 and is applicable to
products manufactured after November 12, 2008. The requirements of the CPSIA are that all wearable
apparel, intended for use by children 12 years of age and younger, undergo specific test related to hazardous
substances, flammability, lead content and absence of phthalates.

Out of Hand Graphics would like to confirm that they have received confirmation from all of their apparel
suppliers that they are compliant with the CPSIA requirements and that all the products they sell are by their
nature free of hazardous substances, lead and phthalates. The products are exempt from flammability testing
because Federal regulations provide testing exemptions for products made from fabrics that weigh more than
2.6 ounces per square yard. The products are made from heavier fabrics and therefore are exempt from this
requirement. They have also tested and verified that any of their snaps, labels and elastic meet the
requirements of CPSIA.

Out of Hand Graphics uses only Wilflex Epic ink from PloyOne Corporation on all garments intended for
children 12 years of age and younger. PolyOne states the following regarding its Epic inks:


1) They are manufacture in compliance with the following 2008 CPSIA requirements:
- 16 CFR, Part 1303, Lead in Paint (<90 ppm lead)
- CPSIA Section 101, Lead Content in substrates (<300 ppm lead)

2) They do not intentionally contain the following restricted materials:
- Heavy Metals: Lead Chromium VI, Mercury, Nickel, Cadmium
- Organotins
- Flame Retardants: TRIS, TEPA, or PBB
- Natural Rubber and Latex
- DEHP – di(2-ethylhexyl phthalate)
- Skin Sensitizing Dyes
- Alkylphenolethoxolates (APEOs)

3) They are manufactured in compliance with:
- CPSIA 2008, Section 108, Phthalates (<.1% DEHP, DBP, BBP, DINP, DIDP, DNOP)
- Oeko-Tex Standard 100
- Epic – Eco Passport Certified

Our expectation is that The Consumer Product Safety Commission should be posting its procedures for
accrediting labs to test for phthalates in June 2009 or at a future date. Once these procedures have been
established, Out of Hand Graphics will have its product tested and certified by an accredited third party
laboratory.

The CPSC released a bulletin on 1/30/09 stating that it has granted a one year stay of testing and certificationrequirements for these children’s products. However, they will still need to meet the lead and phthalate
limits. The procedures we have followed to date are still applicable to the stated limits, and enable you to
have confidence that Out of Hand Graphics is continuing to look out for your best interests as you serve your
customer.
